TERMS and CONDITIONS OF SALE
1. TERMS__________ (INITIAL)
A) A one-third deposit is required to confirm your
sale. Boyles accepts cash, personal checks, MasterCard, or Visa.
All balances which are due at delivery must be paid by personal
check only. In the event of a returned check, your account will
be charged a $30 fee and certified funds will be required for all
future payments.
B) Allocation of Payments. Payments for your individual
sales tickets are applied to a single customer account. If more
than one delivery is required to complete your order, the amount
due will be enough to pay in full for those items being delivered
and retain a one-third deposit on all undelivered items.
C) All sales tickets are audited. Errors in arithmetic
are subject to correction. Errors in pricing are also subject to
correction with your approval.
In the event you do not approve, Boyles reserves the right to cancel
the sale.
D) If registered to do so with the state of delivery,
Boyles will collect sales and use tax. If not, please be aware that
you may have a use tax liability.
E) All COM (customer's own material) orders are
subject to a $25.00 charge per item to cover insurance and UPS charges.
Fabrics ordered by us must be paid in full at the time of purchase.
2. DELIVERY__________ (INITIAL)
A) Many of Boyles sales are special orders furniture
ordered especially for you from the factory. In most cases, special
orders arrive in 10 to 12 weeks. This is only an estimated time
frame based upon past experience. Boyles cannot be held responsible
for manufacturer delays or changes in shipping dates.
B) Orders not delivered in 30 days are subject
to a 2% (of total order) storage charge per month. Complete orders
that are to be held in storage must be paid in full before they
can be considered for storage.
C) A redelivery charge of 25% of the actual freight
charge (minimum $100) will he imposed if you cancel your confirmed
delivery, or if the check for the balance due is not available.
D) The customer is responsible for notifying Classic
Moving & Storage in advance of any special delivery conditions
and for ensuring the merchandise will fit through doorways, stairways,
corridors, elevators and the like. In some cases a delivery may
require additional help / equipment or be subject to special transportation
or toll charges to access your property. All additional charges
are the customer's responsibility.
E) All orders being shipped directly from the factory
to you must be paid in full at the time of order (fabrics, lamps,
accessories, etc.)
F) Boyles is not responsible for items that will
not fit into the home.
G) All shipments are made FO.B. seller's loading
dock.
3. ORDER CHANGES AND CANCELLATIONS___________ (INITIAL)
A) Boyles does not deliver furniture on approval.
Cancellations or changes will be permitted only if Boyles can do
so with the manufacturer.
B) A restocking fee of 1 /3 of the purchase price
will be charged on any cancellations.
C) COM fabric cannot be cancelled or refunded.
4. REFUNDS AND CREDITS___________ (INITIAL)
A) All authorized refunds of payments by cash or
check will be issued from our accounting office within two weeks
of the cancellation, or return of the merchandise to our distribution
center or store.
B) All authorized refunds of payments made by MasterCard,
Visa or will be credited to the originally charged account within
two weeks of the cancellation, or return of the merchandise to our
distribution center or store.
5. LIMITED WARRANTY_____________ (INITIAL)
A) Boyles warrants merchandise included in this
contract for one year after delivery. We will repair or replace
at our option any defective merchandise at no charge. Defects caused
by abuse or negligence are not covered. Boyles cannot warrant furniture
used in rental properties.
B) This warranty does not apply to "AS-IS"
merchandise or goods moved to another address. Defects caused by
abuse or negligence are not covered.
C) This warranty applies only to the original purchaser
upon proof of purchase. This warranty gives you legal rights and
you may have other rights which vary from state to state.
D) Customers must report any scratches, dents,
chips, tears, soil, etc. within 72 hours of delivery.
E) We do not warrant the wearing ability, color-fastness,
stretching or shrinking of furniture coverings as they are not guaranteed
by the manufacturer. Colors may vary somewhat due to dye lot variations
and therefore we cannot assume responsibility for shade variations
between sample swatches and the final product.
F) Color and grain variations in wood and leather
are "nature's own" and enhance the value of your furniture.
Additionally, the inherent characteristics of fine woods affect
how they absorb stains. As a result, Boyles cannot ensure the matching
of related pieces or various surface stains on the same item.
G) Fossil stone, marble, and granite are natural
products. Inconsistencies in color and grain should he expected
and appreciated. Fillers are often used to enhance the surface beauty.
These characteristics are within industry standards and are acceptable.
H) Glass, mirrors, lucite, and metal finishes may
be subject to small seeds, slight areas of discoloration, minor
surface or subsurface scratches. Inconsistent weld points are inevitable
in furniture hand crafted of metal. These characteristics are within
industry standards and are acceptable.
I) Due to the nature of wall construction, we cannot
assume responsibility for wall-hung mirrors and accessories after
installation.
J) No warranty or change of terms and conditions
either expressed or implied shall he valid unless documented on
this contract and approved by management.
