WEBSITE TERMS AND CONDITIONS OF SALE

1. TERMS
A) In order to process your order, we require payment in full at the time of your on-line purchase. You may pay with your MasterCard or Visa.
B) All sales tickets are audited. Errors in pricing or arithmetic are subject to correction with your approval. In the event you do not approve and agree to pay the corrected sales price, we reserve the right to cancel the sale.
C) We will provide free shipping for all products delivered by UPS. Products not delivered by UPS will have the shipping charge calculated based on the zip code of delivery and the amount of the purchase. Any shipping charges will be added to your bill and will appear as a separate line item prior to the completion of your order. We reserve the right to determine which items will be shipped by UPS.
D) These Conditions of Sale constitutes the entire agreement with respect to your purchase of furniture and accessories from us, including the delivery thereof, and supersedes all proposals, documentation, communications and agreements, whether written or oral, or previously or contemporaneously given.

2. DELIVERY
A) Purchases of accessories may be shipped to you directly from the manufacturer's warehouse by UPS. In most cases, you will receive these items within 4 to 6 weeks. Certain items may require delivery by a common carrier specializing in furniture delivery. These items will generally be shipped within 4 to 8 weeks of your purchase. These time periods are only estimates based upon past experience. We are not responsible for manufacturer delays or changes in shipping dates. All shipments are made FOB Seller's Loading Dock.
B) In the event your items will not be delivered by UPS, a representative of the common carrier that will deliver your items will contact you to arrange delivery. This contact will occur shortly after our receipt of an item purchased by you. You will be given 30 days from the date we receive each item to accept delivery. Failure to accept any item within the 30 day period will result in a monthly storage charge equal to 1% of its total purchase price. In the event you fail to accept your order within 6 months you will be responsible for a restocking fee equal to 1/3rd of the purchase price. Prior to delivery you will need to provide written directions to your home. We reserve the right to have items shipped in one or more shipments.
C) You are responsible for notifying us in advance of any special delivery conditions and for ensuring the merchandise will fit through doorways, stairways, corridors, elevators, etc. If delivery to a designated area is not reasonably possible, delivery will be made to an accessible area as determined by the delivery personnel.
D) In some cases, a delivery may require additional help/equipment or be subject to special transportation or toll charges to access your property. All additional charges are your responsibility. In the event that the delivery location is not accessible by the common carrier's vehicles, the delivery will be made to the nearest accessible point and you will be responsible for delivery from that point.
E) You will be assessed a redelivery charge in the event that no one is present to accept a scheduled delivery or such delivery is cancelled or refused.

3. ORDER CHANGES AND CANCELLATIONS
A) Cancellations or changes are not permitted. In our discretion, we may permit changes and cancellations in certain limited circumstances. In the event we elect to permit a cancellation or change you will be charged a restocking fee equal to 1/3rd of the purchase price plus any applicable delivery charges.
B) Orders are subject to the manufacturer's approval.
C) Furniture and accessories purchased from us are not shipped on approval.

4. REFUNDS AND CREDITS
All authorized refunds will be credited to the originally charged account within two weeks of the cancellation, or return of the merchandise to our distribution center.

5. SALES TAX AND USE TAX
A) If registered to do so with the state of delivery, Boyles will collect sales and use tax. If not, please be aware that you may have a use tax liability. Boyles.com shopping cart will calculate the sales tax rate and add it to your online order before checkout. B) Purchases by customers of other states may be subject to a "use tax." You are encouraged to consult with your own tax advisor or revenue officials concerning the state and local tax laws in your jurisdiction.

6. LIMITED WARRANTY
A) We warrant the merchandise included in this contract against manufacturer defect for a one year period after delivery. We will repair or replace, at our option, any defective merchandise at no charge. Defects caused by abuse or negligence are not covered.
B) This warranty applies only to the original purchaser upon proof of purchase.
C) We do not warrant the wearing ability, color-fastness, stretching or shrinking of furniture or accessories, as they are not guaranteed by the manufacturer. Colors may vary somewhat due to dye lot variations and therefore we assume no responsibility for variations between sample swatches and the final product.
D) We do not warrant color and grain variations in wood and leather. Additionally, the inherent characteristics of fine woods affect how they absorb stains. As a result, we cannot ensure the matching of related pieces or various surface stains on the same item.
E) Fossil stone, marble, and granite are natural products. Inconsistencies in color and grain should be expected and appreciated. Fillers are often used to enhance the surface beauty. These characteristics are within industry standards and are acceptable and we make no warranty with respect thereto.
F) Glass, mirrors and metal finishes may be subject to small seeds, slight areas of discoloration, minor surface or subsurface scratches. Inconsistent weld points are inevitable in furniture hand crafted of metal. These characteristics are within industry standards and are acceptable and we make no warranty with respect thereto.
G) No change of these Conditions of Sale, either expressed or implied, shall be valid unless documented and approved by our management in writing.
H) EXCEPT AS EXPRESSLY SET FORTH HEREIN, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ITEMS PURCHASED BY YOU, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. WE SPECIFICALLY DISCLAIM ANY SUCH WARRANTIES.
J) We are not responsible for any indirect, special or consequential damages associated or related to your purchase or the delivery thereof.
