CONDITIONS OF SALE

TERMS _______________ (INITIAL)
A. A fifty-percent (50%) deposit of the total invoiced amount is required to confirm this transaction. The total invoiced amount will include product costs, all applicable state, federal, and local taxes, delivery charges and any other miscellaneous charges set forth on this invoice. Boyles accepts cash, personal checks, MasterCard, and Visa.
B. The remaining balance of the total invoiced amount must be paid in full when delivery is scheduled. In the event of a returned check, your account will be charged a $30 fee and certified funds will be required for all future payments.
C. All sales tickets are audited. Errors in arithmetic or sales taxes are subject to correction. Errors in pricing are also subject to correction with your approval. In the event you do not approve, Boyles reserves the right to cancel the sale.
D. If registered to do so with the state of delivery, Boyles will collect sales and use tax based on possession date. If not, you may have a tax liability.
E. Items to be paid in full at time of purchase:
- 1. All orders being shipped directly from manufacturer to you,
- 2. in-stock items,
- 3. fabrics ordered by Boyles must be paid in full inclusive of all delivery charges and any applicable sales tax at the time of order.
- 4. COM (customer's own material) orders are subject to a $25.00 charge per item to cover insurance and UPS charges.

DELIVERY _______________ (INITIAL)
A. Professional In-Home Delivery service is available through one of our recommended service providers. The estimated charges for service offerings will be provided to you at the time of purchase and then included on your sales receipt appropriately.
B. Many of Boyles' sales are special order products ordered especially for you from a manufacturer. The estimated delivery date provided to you at the time of purchase is based on manufacturers' lead times provided to Boyles, which historically has approximated 8 to 12 weeks. Boyles cannot be held responsible for manufacturer changes in delivery dates.
C. Customers must report any scratches, dents, chips, tears, soil, etc. by noting discrepancies on the Carrier delivery document and notify Boyles Customer Service while driver is at the delivery location to initiate a claim, or provide notice within 24 hours of delivery.
D. Complete customer orders not delivered in 30 days must be paid in full, at which point, a Storage Charge will begin to accrue at 3% (of total orders) per month and prorated for partial month storage. Maximum storage period is one year. Delivery not accepted within one year will result in order cancellation and forfeiture of payments.
E. A redelivery fee will be imposed if you cancel your confirmed delivery.
F. Delivery fees are non-refundable.

ORDER CHANGES, REFUNDS AND CANCELLATIONS ______________ (INITIAL)
A. Please refer to Manufacturer's warranty for all merchandise purchased.
B. Manufacturer warranties may apply. Boyles is not responsible or liable for any costs associated with product warranty claims. All product warranty claims are solely between customer and manufacturer.
C. Boyles does not warrant the wearing ability, color-fastness, stretching or shrinking of furniture coverings as they are not guaranteed by the manufacturer. Colors may vary somewhat due to dye lot variations and therefore Boyles cannot assume responsibility for shade variations between sample swatches and the final product.
D. Color and grain variations in wood and leather are "nature's own" and enhance the value of your furniture. Additionally, the inherent characteristics of fine woods affect how they absorb stains. As a result, Boyles cannot ensure the matching of related pieces or various surface stains on the same item.
E. Fossil stone, marble, and granite are natural products. Inconsistencies in color and grain should be expected and appreciated. Fillers are often used to enhance the surface beauty. These characteristics are within industry standards and are acceptable.
F. Glass, mirrors, lucite, and metal finishes may be subject to small seeds, slight areas of discoloration, minor surface or subsurface scratches. Inconsistent weld points are inevitable in furniture hand crafted of metal. These characteristics are within industry standards and are acceptable.
G. Due to the nature of wall construction, Boyles cannot assume responsibility for wall-hung mirrors and accessories after installation.
H. No change of terms and conditions either expressed or implied shall be valid unless documented on this contract and approved by management.
