CONDITIONS OF SALE


TERMS

  1. All items will be paid in full at time of purchase, except as set forth in section B below:
    1. All orders being shipped directly from manufacturer to you;
    2. in-stock items; and
    3. fabrics (and all delivery charges and any applicable sales tax) ordered by Boyles.
    4. COM (customer’s own material) orders are subject to a $25.00 charge per item to cover insurance and shipping charges. 
  2. If the items will take longer than 30 days, a fifty-percent (50%) deposit of the total invoiced amount is required to confirm this sale.  The total invoiced amount will include product costs, applicable state, federal, and local taxes, delivery charges and any other miscellaneous charges set forth on this invoice.  The remaining balance of the total invoiced amount must be paid in full when delivery is scheduled. Boyles accepts cash, personal checks, MasterCard, and Visa.
  3. In the event of a returned check, your account will be charged a $30 fee and certified funds will be required for all future payments. 
  4. All sales tickets are audited.  Errors in invoiced arithmetic or sales taxes are subject to correction. Errors in invoiced pricing are also subject to correction with your approval. If you do not approve, Boyles reserves the right to cancel the sale.
  5. If registered to do so with the state of delivery, Boyles will collect sales tax, which will be paid to the applicable state when Boyles is paid in full.  If Boyles does not collect sales tax, you may have a sales and use tax liability to the state of delivery.

Clearance and Warehouse Items sold “AS IS”- ALL SALES FINAL – NO REFUNDS, EXCHANGES, OR STORE CREDIT

DELIVERY

  1. Professional In-Home Delivery service is available through one of our recommended service providers.  The estimated charges for service offerings will be provided to you at the time of purchase and then included on your sales receipt .
  2. Many of Boyles’ sales are special order products ordered especially for you from a manufacturer.  The estimated delivery date provided to you at the time of purchase is based on manufacturers’ lead times provided to Boyles.  Boyles is not responsible for manufacturer changes in delivery dates.
  3. Customers must report any scratches, dents, chips, tears, soil, etc. by noting discrepancies on the Carrier delivery document and notify Boyles Customer Service while driver is at the delivery location to initiate a claim, or provide notice within 24 hours of delivery.
  4. Completed customer orders not delivered in 30 days must be paid in full.  Storage charge will accrue at 3% of the total invoiced amount per month, prorated for partial month storage.  Maximum storage period is one year, after which your order will be cancelled, all payments will be forfeited and you will have no right to a refund.
  5. You will be required to pay a redelivery fee if you cancel your delivery.
  6. Delivery fees are non-refundable.

ORDER CHANGES, REFUNDS AND CANCELLATIONS

  1. Cancellations or changes to your order will be permitted only if Boyles can do so with the manufacturer at no charge or unless you pre-pay any charges assessed by the manufacturer.
  2. A restocking fee of 50% of the purchase price will be charged on any cancellation.
  3. Products purchased from Boyles using COM cannot be cancelled or refunded.

PRODUCT WARRANTY

  1. Manufacturer warranties may apply. Please refer to Manufacturer’s warranty for all merchandise purchased.  Boyles makes no warranties except as expressly set forth in these terms of sale.
  2. Boyles is not responsible or liable for any costs associated with product warranty claims.  All product warranty claims are solely between customer and manufacturer. 
  3. Boyles does not warrant the wearing ability, color-fastness, stretching or shrinking of furniture coverings as they are not guaranteed by the manufacturer. Colors may vary somewhat due to dye lot variations and therefore Boyles cannot assume responsibility for shade variations between sample swatches and the final product.
  4. Color and grain variations in wood and leather are “nature’s own” and enhance the value of your furniture. Additionally, the inherent characteristics of fine woods affect how they absorb stains. As a result, Boyles cannot ensure the matching of related pieces or various surface stains on the same item.
  5. Fossil stone, marble, and granite are natural products. Inconsistencies in color and grain should be expected and appreciated. Fillers are often used to enhance the surface beauty. These characteristics are within industry standards and are acceptable.
  6. Glass, mirrors, Lucite®, and metal finishes may be subject to small seeds, slight areas of discoloration, minor surface or subsurface scratches. Inconsistent weld points are inevitable in furniture hand crafted of metal. These characteristics are within industry standards and are acceptable.
  7. Due to the nature of wall construction, Boyles cannot assume responsibility for wall-hung mirrors and accessories after installation.

OTHER

A.      No changes to these Conditions of Sale shall be valid unless put in writing and signed by you and by a member of Boyles’ management team.

B.      These Conditions of Sale (i) set forth Boyles’ and your obligations with respect to the matters addressed herein and (ii) are governed by North Carolina law.
