BOYLES TERMS AND CONDITIONS OF SALE

 

By purchasing goods from Boyles, you agree to be bound by these terms and conditions of sale, the website terms of use and privacy policy and all disclaimers and terms and conditions that appear elsewhere on the Boyles.com website.

Our Customer Pledge

Boyles is committed to providing excellent customer service and we want you to be delighted with the products you have purchased from us. Our policies are designed to be fair to both of us. We will do our best to help resolve an issue and make sure your experience with Boyles is a good one. Please read the terms and conditions thoroughly as it will greatly aid in making the transaction as smooth as possible. Please let us know if you have any questions.

Terms and Conditions

The customer is responsible for thoroughly inspecting all items at the time of delivery. Furthermore, it is the responsibility of the customer to notify Boyles immediately of any damage. If Boyles is not notified immediately of any damage or defect, customer has deemed to have accepted the product as is. Boyles can be contacted by phone at 1-888-848-4551 or by email at [email protected] Boyles reserve the right to repair any damages. Boyles will determine if a damage is repairable. In the event that repair is not possible, Boyles will provide a replacement piece within a reasonable time. Returns or refunds, if applicable, relating to damage will only be accepted or issued as a result of our inability to repair or reorder an item.

PURCHASES AND PAYMENT

A. All items, including in-stock items, items shipped directly from the manufacturer, and fabrics, must be paid in full at time of purchase (plus sales tax and delivery charges), except as set forth in section B. Boyles accepts cash, personal checks, MasterCard, Visa, American Express and Discover.

B. If the item is not in stock and has to be produced, a fifty-percent (50%) deposit of the total invoiced amount, including sales tax and delivery charges, is required at time of purchase. The remaining balance of the total invoiced amount must be paid in full before delivery is scheduled.

C. “COM” orders (customer’s own material”) are subject to an additional $25.00 charge per item for insurance and shipping charges.

D. Your account will be charged a $30 fee for a returned check and certified funds will be required for all future payments.

E. Errors in invoiced arithmetic, sales taxes and invoiced pricing are subject to correction. If you do not approve of a correction in invoiced pricing, Boyles reserves the right to cancel the sale.

F. If registered to do so with the state of delivery, Boyles will collect and remit sales tax when Boyles is paid in full. If Boyles does not collect sales tax, you may have sales and use tax liability to the state of delivery.

G. Clearance and Warehouse Items are sold “AS IS”- ALL SALES FINAL – NO REFUNDS, EXCHANGES, OR STORE CREDIT

Liability

BOYLES SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL LOSSES, DAMAGES OR EXPENSES, DIRECTLY OR INDIRECTLY ARISING FROM THE SALE, HANDLING OR USE OF THE GOODS, OR FROM ANY OTHER CAUSE RELATING THERETO. BOYLES’ LIABILITY AND YOUR EXCLUSIVE REMEDY IS EXPRESSLY LIMITED TO THE REPLACEMENT (IN THE FORM ORIGINALLY SHIPPED) OF GOODS NOT COMPLYING WITH THESE TERMS AND CONDITIONS OR, AT BOYLES’ ELECTION, TO CREDITING YOU WITH AN AMOUNT EQUAL TO THE PURCHASE PRICE OF SUCH GOODS, WHETHER CLAIMS ARE FOR BREACH OF WARRANTY, NEGLIGENCE OR OTHERWISE.

PRODUCT WARRANTY

A. BOYLES MAKES NO WARRANTY, WHETHER OF MERCHANTABILITY, FITNESS OR OTHERWISE, EXPRESS OR IMPLIED, CONCERNING THE GOODS, AND EXPRESSLY DISCLAIMS ANY AND ALL SUCH WARRANTIES.
B. Manufacturer warranties may apply. Please refer to Manufacturer’s warranty for all merchandise purchased.
C. Boyles is not responsible or liable for any costs associated with product warranty claims. All product warranty claims are solely between customer and manufacturer.
D. The wearing ability, color-fastness, stretching or shrinking of furniture coverings are not guaranteed. Colors may vary somewhat due to dye lot variations and there may be shade variations between sample swatches and the final product.
E. Color and grain variations in wood and leather are “nature’s own” and enhance the value of your furniture. Additionally, the inherent characteristics of fine woods affect how they absorb stains. The matching of related pieces or various surface stains on the same item is not guaranteed.
F. Fossil stone, marble, and granite are natural products. Inconsistencies in color and grain should be expected and appreciated. Fillers are often used to enhance the surface beauty. These characteristics are within industry standards.
G. Glass, mirrors, Lucite®, and metal finishes may be subject to small seeds, slight areas of discoloration, minor surface or subsurface scratches. Inconsistent weld points are inevitable in furniture hand crafted of metal. These characteristics are within industry standards.
H. Neither Boyles nor manufacturer has responsibility for wall-hung goods after installation.

Other

Boyles reserves the right to make changes to these Terms and Conditions of Sale at any time.
These Terms Conditions of Sale (i) set forth Boyles’ and your obligations with respect to the matters addressed herein and (ii) are governed by North Carolina law.
